Please read these terms carefully before using our platform. By accessing our services, you agree to be bound by these terms and conditions.
Definitions
"Platform"
UK Driving School website, mobile applications, and related services.
"Learner"
An individual booking or purchasing driving lessons through the Platform.
"Customer"
Collectively refers to Learners and Instructors.
"SaaS Application"
UK Driving School website, mobile applications, and related services.
Nature of the Services
- UK Driving School operates as a technology platform connecting Instructors and Learners.
- We do not provide driving instruction directly. All lessons are delivered by independent Instructors.
- Contracts for driving instruction are exclusively between the Instructor and Learner. The Platform is not a party to such contracts.
- The SaaS Application is a tool to assist Instructors with managing lessons, schedules, and student data.
Eligibility
- Users must be at least 18 years old to register an account.
- Learners under 18 must use the Platform with parental or guardian consent.
- Instructors must hold all required licenses, certifications, and insurance in compliance with UK law.
Account Registration and Responsibilities
- Users must provide accurate, current, and complete information during registration.
- Users are responsible for maintaining the confidentiality of account credentials.
- Accounts may not be transferred, shared, or used by unauthorized persons.
Instructor Responsibilities
- Instructors must ensure that all information on the Platform is accurate and truthful, including qualifications, pricing, and availability.
- Instructors are solely responsible for maintaining all required licenses, permits, and insurance.
- Instructors agree to deliver lessons professionally, safely, and lawfully.
- Instructors may not solicit payments outside the Platform to avoid commissions.
Learner Responsibilities
- Learners must provide accurate information for bookings and payments.
- Learners must comply with safety instructions and conduct themselves respectfully during lessons.
- Learners may not misuse the Platform, engage in fraudulent conduct, or harass Instructors or other users.
Payments, Fees, and Taxes
- All payments are processed through Stripe, Inc. ("Stripe"), our third-party payment processor. By using the Platform, Users agree to Stripe's Terms of Service and Privacy Policy.
- Learners authorise the Platform to process payments via Stripe on behalf of Instructors.
- Instructors provide their bank account details within the Platform for payouts. They are not required to set up separate Stripe accounts.
- The Platform automatically deducts commission and applicable fees before transferring the remaining balance to Instructors.
- Instructors are responsible for reporting and paying any taxes arising from earnings.
- We do not store or have access to sensitive payment card information. All card details are processed securely by Stripe.
- We are not liable for delays, failed payments, chargebacks, or errors arising from Stripe's systems.
Cancellations and Refunds
- All lesson cancellations and refunds are managed directly by the Instructor. The Platform does not guarantee, facilitate, or process refunds.
- Refunds are subject to the Instructor's cancellation and refund policies, which must be disclosed to Learners prior to booking.
- Refunds may not include Platform fees, which are non-refundable.
- Instructors may provide refunds via the original payment method, cash, or another mutually agreed method.
- Learners acknowledge that the Platform is not liable for disputes related to refunds or cancellations.
SaaS Application License
- Subject to payment of subscription fees, Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the SaaS Application.
- Users may not copy, modify, reverse-engineer, sublicense, or resell the SaaS Application.
- Access is provided on an "as-available" basis and may be interrupted for maintenance or technical issues.
Prohibited Conduct
- Users may not:
- Use the Services for unlawful or fraudulent purposes;
- Harass, abuse, or harm other users;
- Attempt to circumvent Platform fees or commissions;
- Interfere with or disrupt the Platform, its systems, or networks.
Ratings and Reviews
- Learners may leave reviews regarding Instructors. Reviews must be truthful, respectful, and accurate.
- The Platform reserves the right to remove reviews that are misleading, defamatory, or violate these Terms.
Intellectual Property
- All intellectual property rights in the Platform and SaaS Application, including trademarks, logos, software, and content, remain the property of UK Driving School or its licensors.
- Users may not use UK Driving School intellectual property without prior written consent.
Data Protection and Privacy
- Collection and processing of personal data are governed by our Privacy Policy, which forms part of these Terms.
- Instructors agree to handle Learners' personal information solely for the purpose of providing lessons and in compliance with applicable privacy laws.
Disclaimers
- We do not guarantee the quality, safety, or outcome of lessons provided by Instructors.
- The SaaS Application is provided "as-is" without warranties of uninterrupted availability or fitness for a particular purpose.
- Use of the Services is at the User's sole risk.
Termination
- We may suspend or terminate access to the Services if Users breach these Terms or applicable laws.
- Users may terminate their account at any time.
- Upon termination, all rights and licenses granted to Users under these Terms cease immediately.
Governing Law and Dispute Resolution
- These Terms are governed by the laws of the United Kingdom.
- Any disputes shall be resolved through binding arbitration or mediation in the UK, unless otherwise required by law.
Amendments
- UK Driving School may amend these Terms at any time by posting updated versions on the Platform.
- Continued use of the Services constitutes acceptance of the revised Terms.
